Who should complete this business formality?
|
The owner of the 'layout-design integrated circuits' that means a three-dimensional disposition however expressed, of an integrated circuit at least one element of which is an active element and some or all of the interconnections of an integrated circuit or such a three dimensional disposition prepared for an integrated circuit intended for manufacture and that owner intends to get the full protection over such layout-design of integrated circuits within Lao PDR

Qualifications needed by the business to get the formality
|
- Persons eligible for protection of industrial property shall be as follows:
1. a Lao citizen or resident in the Lao PDR, or a legal entity or organization
established under the laws of the Lao PDR;
2. an individual that is a national or a resident of any country which is a member of the Paris Convention or other international agreement relating to the protection of industrial property and of which the Lao PDR is also a member;
3. an individual, legal entity or organization with a real and effective industrial or commercial establishment in the territory of any member of the Paris Convention or of any other international agreement that relates to the protection of industrial property and of which the Lao PDR is also a member.international agreement that relates to the protection of industrial property and of which the Lao PDR is also a member.
- A layout-design of integrated circuit eligible for lay-out design of integrated circuit certificate shall meet all the following requirements:
1. the layout-design is original which is not similar to the layout-design of others which is created from an idea of a creator and is not commonplace among creators of layout- designs and manufacturers of an integrated circuit at the time of its creation;
2. the layout-design consists of an integration of elements and interconnections that are commonplace shall be protected only if the combination, taken as a whole, fulfills the conditions of item 1;
3. the application for registration is submitted before the layout-design circuit is commercially exploited anywhere in the world by the right holder or within two years from the date of commercial exploitation.

Additional Comment

- Any individual, legal entity or organisation residing in a foreign country, who intends to apply for this Formality shall appoint an authorised representative in Lao PDR to carry out transactions relating to this Formality in Lao PDR
- Application and any supporting documents may be filed in either Lao or English language; provided, however, that for any application filed in English, the applicant must within 90 days of such filing supply a Lao translation as certified to the authority again.
- A layout-design of integrated circuit eligible for lay-out design of integrated circuit certificate shall meet all the following requirements:
